Eligibility

By registering with The Card Co. (TCC) and accessing the TCC Services, you are representing the following:

  • You are capable of entering into a legally binding agreement;
  • You are not barred or otherwise legally prohibited from accessing or using the TCC App and TCC Services;
  • If you allow anyone to use your account, you will be responsible for ensuring that such individuals comply with these Terms of Use. You will be responsible for all actions these individuals take in and/or through your account. You also acknowledge that TCC does not have the responsibility of ensuring that You meet the aforesaid eligibility requirements.

Please read the terms and conditions carefully before registering, accessing or using the TCC Services (defined below) offered through the TCC website, TCC App (defined below) or through applications or websites of TCC Group Entities (defined below). These terms and conditions are a legal contract ("Terms of Use") between You and Pockket Payment Technologies Private Limited (TCC) having its registered office at Unit No. 36B, Ground Floor, Tower B1, Spaze I-Tech Park, Sector 49, Sohna Road, Gurugram, Haryana - 122018 and its corporate office at 822, 8th Floor, Tower B4, Spaze I-Tech Park, Sector 49, Sohna Road, Gurugram, Haryana - 122018. You agree and acknowledge that you have read the terms and conditions set forth below. If you do not agree to these Terms of Use or do not wish to be bound by these Terms of Use, you may not use the TCC Services and/or immediately terminate the Services and/or uninstall the TCC App.

Definitions
  • "The Card Company", TCC", "Pockket Payment Technologies Pvt Ltd", "Pockkets", "PPTPL" “We”, “Us”, “Our” means The Card Company and TCC Group Entities.
  • “You”, “Yours”, “Yourself”, “User” means any prospective user, or registered user of TCC and TCC Group Entities, including but not limited to customers and Commercial Partners.
  • “TCC App” means mobile application(s), hosted by TCC and TCC Group Entities for providing services to the Users, and Commercial Partners.
  • “TCC Group Entities” means subsidiaries and affiliates of TCC.
  • “TCC Platform” means any platform owned/subscribed/used by TCC or TCC Group Entities including but not limited to the TCC Website, the TCC App, other mobile applications, devices, URLs/links, notifications, chatbots, TCC's social media channels or any other communication medium or mechanism used by TCC or TCC Group Entities to provide services to the Users.
  • “TCC Website” means https://thecardcompany.in or any other website hosted or registered by TCC or TCC Group Entities.
  • “TCC Services” means and include all services offered / to be offered by TCC, and TCC Group Entities either directly or through its Commercial Partners including but not limited to Credit Card Bill Payment Services, TCC Wallet Services, Bill Payment Services, Mobile Recharge.
  • “Commercial Partner” means any individual or entity with whom TCC or TCC Group Entities have a contractual relationship and includes but is not limited to entities offering rewards on TCC App, etc.
  • “Terms of use” / “Terms and Conditions” are interchangeably used and mean these Terms of Service including the Supplemental Terms.
Your Use of TCC

You agree that:

  • Unless otherwise permitted by TCC in writing, You may only possess one account.
  • Your use of the App shall not violate any applicable law or regulation.
  • Your use of the TCC App, and TCC Platforms shall be only for personal purposes.
  • All registration information you submit is truthful, complete and accurate and you agree to maintain accurate, complete and up-to-date account information in your account.
  • You are responsible for all activity that occurs under your account.
  • You are responsible for maintaining the confidentiality of the access credentials of your account and are fully responsible for all activities that occur under your account. You agree to immediately notify TCC of any unauthorized use of your passcode, mPIN or account or any other breach of security.
  • You agree that You are aware and responsible for all transactions taking place through your Account. You shall continue to be responsible for the transactions in your account, if you knowingly or negligently (i) grant any other person access to your TCC App, (ii) permit them to transact on Your account, or (iii) transact on any other person’s behalf or directions; whether by sharing one-time passwords or in any other manner.
  • You shall not indulge in decompiling, reverse engineering, disassembling content, removing any intellectual property right associated with the TCC App, including our copyright, trademarks, trade secrets, designs, and patents, or other proprietary notices.
  • You shall not access or use the TCC App in any manner that (i) may be harmful to the operation of the TCC App or its content; (ii) may be unlawful; (iii) maybe harmful to TCC or to any other User; (iv) may hinder the other User’s enjoyment of the TCC App; or (v) to defraud other Users, TCC or any Commercial Partner.
  • You shall not post, distribute, or otherwise transmit or make available any software or other computer files that contain a virus, other harmful component or malicious content, or otherwise impair or damage the TCC App or any connected network, or otherwise interfere with any person or entity's use or enjoyment of the TCC App.
  • You shall not delete or modify any content of the TCC App.
  • Your use of the TCC App shall indicate that you have provided consent to automatically receive updates such as bug fixes, patches, enhanced functions, missing plug-ins and new versions (collectively, ‘Updates’), for the purpose of effective delivery of the TCC Services. Please note that your continued use of the TCC App following such Updates would mean deemed acceptance by you of the same.
  • You understand and accept that not all products, services and rewards offered on the TCC App are available in all geographic areas and you may not be eligible for all the products, services and rewards offered by TCC on the TCC App or other TCC Platforms. TCC reserves the right to determine the availability and eligibility for any product, services and rewards offered on the TCC App or any TCC Platform.
  • You shall request TCC, to block the Account and change the passcode immediately for the account, if your device has been lost or stolen.
Supplemental Terms and delivery of services through TCC Group Entities

You agree and acknowledge that several features including but not limited to TCC's My Wallet, My Dues and Rewards, are subject to certain supplemental Terms of Use set out below. Your usage of any features that have a set of Supplemental Terms of Use is deemed to be acceptance of the said Supplemental Terms of Use. You further agree that any TCC Services may be provided to You either directly by TCC or by any TCC Group Entity.

Violation of Terms of Use / Suspicious Activity

If We believe that you have violated any of the conditions as mentioned under these Terms of Use, our Privacy Policy, Supplemental Terms applicable to certain services or any agreements consented to via the TCC App, we reserve the right to suspend your access to the TCC App and/or delete your account without prior notice to You, and reverse any transaction undertaken by You. If We have reason to believe that there is suspicious or unusual activity being carried out through your account, we may temporarily or permanently suspend your access to the TCC Services, and reverse any transaction undertaken by You. If we suspect that any feature, offer or reward promotion is being availed by You in a manner (i) that is disingenuous ; (ii) that it is not intended to be availed; (iii) that purports to artificially increase (or decrease) your transaction volume or usage of the App (for example: paying rent or credit card bills by breaking them down into numerous smaller transactions); (iv) that is designed to deliberately side step fair use restrictions; (v) that may result in you gaining an undue, unfair or unethical advantage over other Users or Commercial Partners; (vi) that is intended to cause losses or other harm to Commercial Partners, TCC reserves the right to reverse the relevant transaction, suspend the account or restrict you from using the App in its entirety or any specific feature(s) thereof. TCC may ask for additional information / documents if required from time to time including but not limited to Your permanent account number (PAN), in connection with the above. In case you fail to provide such information / documents to TCC satisfaction, TCC may reverse any transactions undertaken by You, and may suspend Your account or restrict You from using the App or any of its features.

You may reach out to the TCC support team to assist you with any query or question arising as a result of the aforementioned suspension/ deletion.

Termination / Deletion of Your Account

You may end your legal agreement with TCC at any time by deactivating your account and discontinuing the use of the TCC Services. We provide all our Users an option through which a User may request archive of a specific card stored on his/her account or deletion/deactivation of the complete account through the support section on the TCC App.

Following a request for deletion, or termination of account by TCC, We consider the agreement to be terminated and take appropriate steps. Provided however, TCC may continue to maintain transaction records for record keeping purposes and/or regulatory reasons. Deletion of the account or Termination also does not terminate Your obligations undertaken prior to deletion or termination of the account. TCC may continue to retain a record of your transactions made on the TCC App for regulatory and archival purposes.

Fees

TCC reserves the right to impose and/or revise charges/commissions in relation to the use of your TCC App, in its sole discretion, without any prior notice. You are responsible for any fees that may be applicable to certain transactions or use of the TCC App; where you will be notified of such applicable fees, prior to the completion of any transaction. By clicking ‘Proceed’ / ‘Submit’ / ‘Continue’ or any other similar button on the TCC App, You shall be deemed to have consented to the fees displayed on the said page.

Privacy

We collect, hold, use and transfer your personal data in accordance with our Privacy Policy. By agreeing to the Terms of Use, you also hereby agree to our Privacy Policy, which may be updated and/or modified by us from time to time. You understand and agree that, to the extent permitted by applicable law, any data provided by you in connection with the TCC Services may be shared with our subsidiaries, affiliates or partners, and/ or used by us for enhancing the TCC Services, including but not limited to creating new products. Please refer to the Privacy Policy for further clarity on the subject.

Disclaimer

The TCC Services, including all content, software, functions, material, and information made available or accessible through the TCC Platform are provided “as is”. TCC, TCC Group Entities and their respective agents, co-branders or partners, make no representation and warranty of any kind for the content, software, functions, material, and information available/accessible through the Services.

TCC does not warrant that the functions contained in content, information and materials on the TCC App, including, without limitation any third-party sites or services linked to the TCC App or any TCC Platform will be uninterrupted, timely or error-free, that the defects will be rectified, or that the TCC App or the servers that make such content, information, and materials available are free of viruses or other harmful components.

Further, You understand that a payment transaction is solely between the User who uses the TCC Services to make his payment (“Sender”) and the User who receives such payment from the Sender (“Recipient”) and that TCC does not provide any guarantees or warranties to any User with respect any service, goods, or delivery level commitment provided by the Recipient. TCC cannot assure that Commercial Partners or other Users are or will be complying with the foregoing Terms of Use or any other provisions mentioned here. You assume all risk of harm or injury resulting from any such lack of compliance by any other User or Commercial Partner. You should ensure that you have undertaken adequate due diligence prior to transferring payments using the TCC App.

Limitation of Liability

In no event shall TCC, TCC Group Entities, their officers, shareholders, subsidiaries, associate companies, directors, employees and agents, partners, co-branders, licensors, licensees, consultants, or contractors be liable to you or any third party for any special, incidental, indirect, consequential or punitive damages or losses whatsoever, or damages for loss of data or profits, goodwill, and/ or other intangible loss, whether or not foreseeable and regardless of whether TCC has been advised of the possibility of such damages, or based on any theory of liability, including breach of contract or warranty, negligence or other tortious action, or any other claim arising out of or in connection with your use of, or access to, the TCC Platforms, TCC App or TCC Services.

In no event shall TCC and TCC Group Entities’ total cumulative liability to You in connection with the TCC Services for all damages, losses and causes of action (whether arising under contract or otherwise), arising from or relating to Your use of the TCC App and TCC Platforms or arising from these Terms of Use exceed INR 10,000 (Indian Rupees ten thousand only).

Indemnity

You agree to defend, indemnify and hold harmless TCC, TCC Group Entities, its officers, owners, directors, employees and agents, partners, co-branders, licensors, licensees, consultants, contractors and other applicable third parties (collectively ‘Indemnified Parties’) from and against any and all claims, demands, damages, obligations, losses, liabilities, cause of action, costs or debt, and expenses (including any legal fees) arising from:

  • Your use of and access to the TCC App and the TCC Platforms;
  • Your violation / breach of any of these Terms of Use;
  • Your violation of any third party right, including any intellectual property right or privacy right;
  • The committing of any of the prohibited activities as stated herein;
  • Our failure to be in compliance with applicable law, including tax laws and cyber security laws; or
  • Any claim that your use of the TCC App caused damage to a third party.
Disputes & Arbitration

In consideration for TCC granting you access to and use of the TCC App, TCC Platforms and TCC Services, you agree that in case of any dispute between You and any Commercial Partner or other User or recipient of the funds transferred by You, TCC shall not be a party to the same. While TCC is not obligated to mediate or resolve disputes, TCC will assist Users in communicating with each other regarding a dispute. TCC may at its own discretion however, without having any obligation to do so, assist in resolving the disputes between the Users and the Commercial Partners.

Except as otherwise set forth in these Terms of Use, these Terms of Use shall be exclusively governed by and construed in accordance with the laws of India. Any dispute, conflict, claim or controversy arising out of or broadly in connection with or relating to the TCC Services or these Terms, including those relating to its validity, its construction or its enforceability, but excluding those provisions where it has been specified that TCC's decision shall be final, (any “Dispute”) shall be, if initiated by the User, first raised by the User to TCC customer support through the TCC App and if not suitably resolved, the user may raise a grievance using the Grievance Redressal Form. If such Dispute has not been settled within sixty (60) days after the User reaches out to the aforementioned email IDs, such Dispute can be referred to and shall be exclusively and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996 (“Act”). Provided however when TCC raises any dispute, TCC may directly initiate arbitration in accordance with this clause. The Dispute shall be resolved by one (1) arbitrator to be appointed by TCC. The place the arbitration shall be Gurgaon, India. The language of the arbitration shall be English. The existence and content of the arbitration proceedings, including documents and briefs submitted by the parties, and correspondence, orders and awards issued by the sole arbitrator, shall remain strictly confidential and shall not be disclosed to any third party without the express written consent from the other party unless: (i) the disclosure to the third party is reasonably required in the context of conducting arbitration proceedings; and (ii) the third party agrees unconditionally in writing to be bound by the confidentiality obligation stipulated herein.

Use and Protection of Intellectual Property Rights

TCC App, TCC Website, TCC logos and the TCC Services are protected by copyright, trademarks, patents, trade secret and/or other intellectual property laws. No information, content or material from the TCC App including, without limitation, all of the page headers, images, illustrations, graphics, audio clips, video clips or text, reports generated, trademarks, tradenames may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way without Our express written permission. You are hereby given a limited licence to use the TCC App and the TCC Platforms, subject to your agreement of these Terms of Use.

TCC, TCC Group Entities, and its licensors, if any, are the sole owners of the underlying software and source code associated with the TCC App and TCC Platforms as well as any other intellectual property rights of any other nature associated with the TCC App, TCC Platforms and their content.

When you upload, submit, store, send or receive content that may include feedback to or through the TCC App, you give TCC and TCC Group Entities a worldwide, perpetual licence to use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly perform, publicly display and distribute such content. This licence shall not expire even if it is not used by TCC or TCC Group Entities. The rights you grant in this licence are for the limited purpose of operating, promoting, and improving the TCC Services, and to develop new ones. This licence continues even if you stop using the TCC Services.

Tax Liability

You hereby agree to comply with any and all applicable tax laws in connection with your use of the TCC Services, including without limitation, the reporting and payment of any taxes arising in connection with payments made through the TCC App, or funds/income received through the TCC Services. You hereby agree and acknowledge that if and when required by applicable law, TCC, may deduct tax deducted at source from your winnings/ cashback and/or may require You to submit PAN details before providing you cashback or other winnings.

Governing Law and Jurisdiction

The TCC App, the TCC Services, all your transactions with the TCC App, and our relationship shall be governed by the laws of India, without regard to conflict of law principles. You agree that subject to the Disputes & Arbitration Clause above, all claims, differences and disputes which we may have shall be subject to the exclusive jurisdiction of the competent courts located in Gurgaon, Haryana, India.

Assignment

You shall not transfer or assign any of Your rights and obligations arising from these Terms of Use.

You agree and acknowledge that TCC may assign or transfer its rights and obligations under these Terms of Use in whole or in part, to (i) any other TCC Group Entity; (ii) an acquirer of TCC or any TCC Group Entity or their respective equity interest, business or assets; or (iii) a successor entity resulting from any corporate action including mergers or demergers.

General

No joint venture, partnership, employment or agency relationship exists between you, TCC, TCC Group Entities or any Third Party as a result of the contract contained in these Terms of Use. If any provision of these Terms of Use is held to be illegal, invalid or unenforceable, in whole or in part, under any law, such provision or part thereof shall to that extent be deemed not to form part of these Terms of Use but the legality, validity and enforceability of the other provisions in these Terms of Use shall not be affected.

In that event, TCC shall replace the illegal, invalid or unenforceable provision or part thereof with a provision or part thereof that is legal, valid and enforceable and that has, to the greatest extent possible, a similar effect as the illegal, invalid or unenforceable provision or part thereof, given the contents and purpose of these Terms of Use. These Terms of Use (together with any additional terms displayed in specific sections of the TCC App or TCC Website) constitute the entire agreement and understanding of the parties with respect to its subject matter and replaces and supersedes all prior or contemporaneous agreements or undertakings regarding such subject matter.

Updation

We may amend these Terms of Use at any time by posting an updated version on the TCC Website. The updated version of these Terms of Use shall supersede the previous version of the Terms of Use and take effect immediately upon posting. You have the right to opt-out of agreeing to these Terms of Use or any future updated version of the Terms of Use, by ceasing to use the TCC App. However, please be aware that your continued use of the TCC Services from the launch of any updated Terms of Use would mean deemed acceptance of such updated Terms of Use including any modification thereof. We recommend you to keep checking the Terms of Use often to be familiar with any updates and changes.

Supplemental Terms for TCC Wallet

These supplemental terms (TCC Wallet T&Cs) are applicable to all Users who sign up for using the TCC Wallet on the TCC App. All Users accessing TCC Wallet shall be deemed to have read, understood and agreed to be bound by these TCC Wallet T&Cs as a part of the Terms of Use.

  • Key Attributes of TCC Wallet
    • TCC Wallet is an online / digital wallet, or a prepaid payment instrument ("PPI") issued by a Pockket Payment Technologies Private Limited (PPTPL)
    • PPTPL is registered with the RBI as a non-bank PPI Issuer, and is authorised to open and operate a PPI wallet / account for any individual. Such individuals who open a wallet with PPTPL may load the wallet with value stored in the wallet for the purchase of goods or services or other remittances.
    • PPTPL, under the brand name of The Card Co. (TCC) will be issuing and operating said wallets (i.e. the TCC Wallet) on the TCC App.
    • Once you open a TCC Wallet and load the same with money, You may use it to make payments against the value You load it with.
    • TCC may make TCC Wallet available to some or all of TCC Users at their sole discretion. They may also suspend or discontinue offering TCC Wallet for any TCC Users at their sole discretion.
    • Features of Min-KYC Wallet i.e where a user has completed only Minimum KYC as stipulated in the Master Directions of RBI.

      2 Loading or Reloading of Funds The total amount loaded or reloaded in the prepaid payment account during any given month shall not exceed INR 10,000/- (Indian Rupees Ten Thousand Only) and the total amount loaded during the financial year shall not exceed INR 1,20,000/- (Indian Rupees One Lac Twenty Thousand Only)
      3 Transfer of funds You will not be able to transfer money from such Min KYC accounts to other Money accounts or bank accounts. The only time you can transfer money out of this account is at the point of closure of your Wallet , at which point you would be required to transfer money to your own bank account post providing required bank account proof of ownership and after completing your Know Your Customer; or transfer money 'back to source' (payment source from where the money was loaded).
      4 Debit from prepaid account The total amount debited from the prepaid payment account during any given month shall not exceed INR 10,000/-(Indian Rupees Ten Thousand Only)
      5 Expiry Period As per the RBI guidelines updated as on November 12, 2021 the new type of Min KYC account has no expiry.
      6 Making the Wallet account inactive In case of no financial transaction for a consecutive period of 1 (one) year in the Prepaid Payment Account, TCC shall make the Account inactive
      7 Usage of the Wallet The wallet can be used only for purchase of goods and services. Fund transfer to other wallets or to bank accounts is not permitted
      8 Closure of Wallet At the time of closure , any outstanding balance in the wallet shall be transferred at the request of the holder to the ‘own bank account of Wallet holder’ or shall be transferred ‘back to source’ after complying with KYC requirements of the Wallet holder.
    • Features of Full-KYC Wallet

      1 Maximum outstanding Balance The maximum outstanding balance must not exceed INR 2,00,000/- (Indian Rupees Two Lacs Only) at any point in time
      2 Loading or Reloading of Funds Shall be reloadable in nature
      3 Fund Transfer from TCC Wallet to Bank Account In case of pre-registered beneficiaries, the fund transfer limit shall not exceed INR 2,00,000/- (Indian Rupees Two Lacs Only) per month per beneficiary.
      4 Expiry Period TCC wallet shall be valid for an indefinite period.
      5 Making the wallet account inactive In case of no financial transaction for a consecutive period of 1 (one) year in the Prepaid Payment Account, TCC wallet shall make the Prepaid Payment Account inactive. Where you wish to reactivate such account, you will have to contact us through our customer care details as mentioned under these T&Cs or as per steps provided on the app / website and comply with applicable validation norms, as prescribed by TCC.
      6 Usage of the Wallet The wallet can be used only for money transfer and purchase of goods and services
      7 Closure of Wallet An option shall be provided at the time of issuing the Wallet , to the holder to provide details of pre designated bank account or other PPI of the same issuer to which such balance amount shall be transferred in the event of closure or expiry of such wallet.
  • Onboarding
    • You may access TCC Wallet by undergoing the wallet onboarding journey on the TCC App.
    • As a part of the onboarding, TCC will require you to complete the Know Your Customer process (which may include provision of your mobile number verified by One Time Password, self declaration of Your name and Your valid KYC records, downloading records from CKYCR and/or Digilocker, video KYC verification, liveliness check, PAN check, bank account validation, fraud screening). You consent to TCC undertaking any of the foregoing as a part of the KYC process.
    • By going through the onboarding journey, You consent to TCC Terms and Conditions and Privacy Policy (both set out here: https://thecardcompany.in).
    • Once You finish the KYC process and the onboarding journey successfully, PPTPL will issue a Min KYC or a Full KYC PPI, as you elect on the TCC mobile application. If you choose to open a Min KYC PPI, You may later upgrade to a Full KYC PPI using the options given on the TCC App. If you face any issues in upgrading Your wallet, please reach out to TCC using the contact information on our “Contact Us” page, or write to at care@thecardcompany.in
    • You agree that depending on the KYC process you choose to undergo while onboarding, PPTPL may impose certain restrictions on the use and functionality of your TCC Wallet at its sole discretion and as may be prescribed under relevant laws.
    • You agree and acknowledge that You: (a) have a valid TCC account; (b) are an Indian citizen; (c) will submit your correct Know Your Customer details; (d) are not a 'Politically Exposed Person' (PEP) in terms of the RBI Know your Customer (KYC) Master Directions, read with the Prevention of Money Laundering Act, 2002 ("KYC Framework"); (e) are a tax resident of India and not a resident of any other country; and (f) will inform TCC in case of any changes in your PEP status, your residency status, or your KYC details.
  • Use of TCC Wallet
    • For your convenience, you can login to access and transact from the TCC Wallet account by using your login credentials used to access the TCC App.
    • You may load money into Your TCC Wallet account using your any of your credit/debit cards, Netbanking, or UPI. Loading of TCC Wallet through certain instruments may attract a nominal fee, same shall be notified on the TCC app at the time of wallet loading.
    • You agree that in case of any change in Your particulars furnished during onboarding, PPTPL reserves the right to suspend or permanently stop Your use of the TCC Wallet. In such a case, PPTPL may either require You to furnish the correct or updated details with proof, or may require You to undergo KYC again or may require You to close your TCC Wallet in accordance with Section 19.4 below.
    • You also agree that if you chose to undergo a min KYC or non-face-to-face KYC process PPTPL reserves the right to require you to undertake Full KYC verification at any point in time at its discretion, and has the right to suspend or permanently stop Your use of the TCC Wallet until the same is complete.
    • PPTPL reserves the right to suspend or permanently stop Your use of the TCC Wallet in case it suspects that there is unusual activity being carried out in or through your TCC Wallet or for such other reasons as PPTPL may deem fit. PPTPL may reach out to you to understand details on source of funds and destination of funds and the you agree to provide correct information.
    • You agree to TCC sharing your phone number and other details to PPTPL, to enable PPTPL to send communications and updates regarding your activity on TCC Wallet.
    • Your data relating to TCC Wallet shall be governed as per TCC’s and PPTPL’s Privacy Policy available at the website https://thecardcompany.in

  • Closure of TCC Wallet
    • Once registered for the TCC Wallet, if you want to log out from TCC Wallet, you may do so by logging out of your TCC account.
    • In case You want to close Your TCC Wallet, You can follow the steps set out in the TCC App for initiating a closure request.
    • Any balance lying in your TCC Wallet will first be transferred Back to Source before any closure. Further, in case any transaction on the TCC Wallet is outstanding / not yet settled at the time of You initiating a closure request, the request will be processed only after such transaction is settled.
    • After any closure of the TCC Wallet, PPTPL will retain Your data for as long as required by PPTPL to comply with applicable Laws. Your data will be stored and governed by the Privacy Policy set out in https://thecardcompany.in
    • You agree and acknowledge that there can be certain risk-based scenarios when Your TCC Wallet may not be immediately closed but suspended and then eventually closed which is solely based at the discretion of PPTPL.
    • You further understand that once Your TCC Wallet is closed, PPTPL may not be able to reinstate Your TCC Wallet and may not allow You to create a new wallet as per regulatory directives or based on PPTPL’s internal policies.
    • If you decide to delete your TCC Account, you would first be required to close the TCC Wallet, by initiating a closure request as set out herein. You acknowledge that Your TCC Account cannot be closed / deleted without the TCC Wallet being closed first. You also acknowledge that irrespective of the closure of your TCC Account, PPTPL may be required to retain certain data of Yours as required under applicable laws, and such data will be stored and governed by Privacy Policy set out in https://thecardcompany.in
  • Fees
    • TCC reserves the right to charge fees in relation to the use and/or termination of the Product / Facility including, without limitation, to revise such fees. TCC shall determine and give reasonable details on the TCC app regarding applicable fees which shall be binding on the User if the User continues to maintain or use the services. Should there be any revisions in recurring fees charged to Users for any services offered by TCC, TCC shall give reasonable notice to Users regarding such revisions before they become effective. Fees may be collected from the User in such manner and at such intervals as TCC may specify.
Supplemental Terms for Video KYC (V-KYC)

These terms and conditions for Video KYC process (“Terms”) apply to and regulate the operation of Video KYC process offered by TCC in India and govern the general relationship between the holder of the TCC Wallet User (“User”) and TCC, having its registered office at: Unit No. 36B, Ground Floor, Tower B1, Spaze I-Tech Park, Sector 49, Sohna Road, Gurugram, Haryana - 122018. These terms shall be in addition to any other terms as stipulated by TCC from time to time on its website/app (“Platform”) whether pertaining to its product/Facility or in relation to other services or offers provided by TCC.

  • Definitions In these Terms applicable to the Video based KYC process the following words and phrases shall have the meaning stated hereunder unless indicated otherwise:
    • “User” shall mean a Resident Indian individual applicant who applies for any product/facility with TCC subject to such product/facility specific terms and conditions as may be specified by TCC from time to time.
    • “KYC” shall mean the ‘Know Your Customer’ process to be completed by TCC as per applicable regulations and guidelines.
    • “Product” / “Facility” shall mean any TCC product or facility that the User has applied/requested for and in respect of which the User has consented to complete the KYC through the Video KYC process.
    • “Video KYC process” / “V-KYC” shall mean the process of KYC verification conducted through a video call feature supported by TCC in line with extant regulations and TCC policy.
    • “Primary Terms and Conditions” shall mean the terms applicable to the Product/Facility being availed by the User.
    • “Platform” shall mean TCC's website https://thecardcompany.in and the TCC App.
  • Applicability of the Terms These Terms and Primary Terms and Conditions form the express contract between the User and TCC. The User shall apply to TCC in the prescribed form for the Product/Facility. By applying, the User acknowledges that he has read, understood and accepted these Terms and the Primary Terms and Conditions as applicable.
  • General Terms for V-KYC process
    • Requirements for availing of V-KYC feature:
      • V-KYC process is available only for Users who are physically present in India and if the same can be confirmed through their live location through geo- tagging and shall be accessible only during the working hours defined by TCC;
      • V-KYC process shall not be available during National holidays;
      • V-KYC process shall work only in good network/internet conditions and
      • User should possess requisite documents and materials as informed on the journey page at the time of the V-KYC process to avoid any inconvenience.
    • On opting for V-KYC process, a two-way video call will be initiated between the User and TCC official to start the V-KYC process.
    • As a part of V-KYC process, the User shall be required to verify their identity by answering certain questions asked by TCC officials through a video call. By proceeding with the video call, the User accepts the Terms herein.
    • The User shall be required to cooperate with TCC officials in every manner and provide all such relevant information/data/documents including but not limited to allowing TCC officials to capture their photographs, photographs/screenshots of various documents (including but not limited to Officially Valid Documents (“OVD”), PAN, etc.), screenshot of the User’s signature on a plain paper as submitted by the User during V-KYC process as and when requested by TCC officials. The User agrees and consents to co-operate and provide all such relevant data/documents, etc. for the purpose of V-KYC process.
    • The User herein agrees to adhere to the following during the course of the V-KYC process:-
      • Be professional and respectful with the verification executive.
      • No profanity, nudity, or illegal activity is allowed during the process.
      • Cooperation is necessary for successful VKYC completion.
      • Note:- non-compliance of any of the above by the Users may result in account suspension or process termination.
    • The User authorizes TCC to collect/store/verify any and all information/details received through the V-KYC process including but not limited to the video call itself, information received from documents/information captured/shared through the video call.
    • In case the documents shown and verified by TCC officials over a video call do not comply with the TCC policy and/or relevant guidelines due to any reason whatsoever, the application request shall be rejected. Users will need to follow alternate processes as outlined from time to time to complete their KYC verification process in such case for completion of the Product/Facility application request. The User agrees and understands that the image of the signature crop provided by the User shall be updated in TCC's records as the User’s specimen signature.
    • Users who have opted for V-KYC process for the Product/Facility application agree that their request is subject to verification and may be rejected by TCC for various reasons including, but not limited to:
      • Call drop due to network/internet issues at the User’s or TCC's end; or
      • Documents matching criteria is not fulfilled or
      • TCC official is unable to capture the screenshot of User’s photo or any document or
      • User is not ready to co-operate with the officials of TCC or
      • Signature process is incomplete or
      • Location outside India, face mis-match, poor quality uploaded documents or
      • For any other reason at the discretion of TCC
    • The User understands that the V-KYC process is subject to the availability of TCC officials to conduct such V-KYC, and technical stipulations including but not limited to those arising due to any delay, interruption, suspension, resolution or error of TCC in receiving and processing the request and in formulating and returning responses or any failure, delay, interruption, suspension, restriction, or error in transmission of any information or request to and from the telecommunication equipment of the User and the network of any internet service provider and TCC's system or any breakdown, interruption, suspension or failure of the telecommunication equipment of the User, or TCC's system or the network of any internet service provider and/or any third party who provides such services as is necessary to provide the V-KYC process.
  • Acceptance of Terms and Conditions
    By accepting these terms and conditions in the digital journey of the V-KYC process, the User shall be deemed to have accorded his approval/consent to (i) complete the KYC verification for the Product/Facility application through V-KYC process (ii) the consents, authorisations, declarations, and undertakings, etc. mentioned therein.
  • Miscellaneous
    • User agrees that all costs incurred at the User’s end (technical/data plan related or otherwise) for completing the V-KYC process shall be borne by the User solely.
    • The User agrees that TCC shall not be liable for any connectivity/signal/data related issues leading to incomplete information/application being provided by the User.
    • In case the Video based KYC process is not completed/submitted for any reason whatsoever, TCC may contact the User for completing offline KYC.
    • User hereby agrees to indemnify, defend and hold harmless TCC from and against any and all liability, loss that may occur, arise from reliance by TCC on the information, declarations, documents, images and undertakings, etc. provided by the User (on account of them being fake/incorrect/erroneous), the usage of online/offline mode for the Product/Facility application including the details provided basis this V-KYC process or breach, non-performance or inadequate performance by the User of any of these Terms, Primary Terms and Conditions or the acts, errors, representations, misrepresentations, misconduct or negligence of the User in performance of its obligations.
    • In case of any inconsistency/inaccuracy/non-completion of any formalities in the V-KYC process or for any other reason whatsoever, TCC may contact the User for offline completion of KYC. The User agrees and confirms that TCC shall at its sole discretion reject the Product/Facility application for any reason whatsoever including but not limited reasons attributable to erroneous, incomplete, misleading information or non-adherence with the relevant norms/non submission of KYC documents to TCC or upon any notice/directions received from any other regulatory body.
    • TCC reserves the right, at any time and from time to time, with or without notice, to cancel, withdraw, suspend, vary, change, add to or supplement the V-KYC process and facilities offered to Users hereunder.
  • Change of Terms
    TCC shall have the absolute discretion to amend or supplement any of these Terms at any time. TCC may communicate the amended Terms by hosting the same on the Website or in any other manner as decided by TCC.
  • Limitation of Liability
    • Neither TCC nor its employees shall be responsible or liable in any way for any direct or consequential loss suffered by the User or any third party or towards any claims that may arise due to the rejections of the Product/Facility application due to the V-KYC process availed by the User.
    • TCC shall not be liable for any failure to perform any obligation contained in these Terms or for any loss or damage whatsoever suffered or incurred by the User or a third party howsoever caused and whether such loss or damage is attributable (directly or indirectly) to any dispute or any other matter or circumstances whatsoever.
    • Under no circumstances shall TCC be liable to the User or a third party for any indirect, incidental, consequential, special or exemplary loss or damages in connection with the V-KYC process.
  • Force Majeure
    TCC shall not be liable for any losses caused by its inability or delay in providing the V-KYC process or fulfilling any of TCC's obligations hereunder, either wholly or in part, caused by or in connection with any force majeure events including, but not limited to, restrictions on convertibility, transferability, requisitions, hacking, involuntary transfers, riot, disturbance, strikes, lock-outs, bandhs, war, civil strife, burglary, theft, dacoit, accident, hacking, technical fault including problems related to computers, accessories, software, printers, fax machines, internet, telephone system and such related hardware and software beyond the control of TCC, breach of trust by any authorised persons, flood, epidemic/pandemic, fire, earthquake, act of God, act of any Government, change in regulation or law and other allied acts of regulatory or statutory nature or if the performance of such obligation or provision of such service would result in the breach of any law, regulation or other requirement of any governmental or other authority or on account of any other restriction or requisition or other circumstances or events whatsoever beyond the control of TCC and TCC shall not be obliged to provide any service or facility or perform any of its obligations hereunder during the period while TCC's performance is affected by force majeure conditions. TCC shall not be responsible for any loss or damage caused to the User by reason of any failure to comply with the User instructions, when such failure is caused due to reasons beyond the control of TCC, the opinion of TCC being final in this regard.
  • Governing Law
    The laws of India shall govern these Terms. The User hereby agrees that any legal action or proceeding arising out of the Terms shall be brought in the courts or tribunals at Gurugram in India and irrevocably submit themselves to the jurisdiction of such courts and tribunals. TCC may, however, in its absolute discretion, commence any legal action or proceedings arising out of the Terms in any other court, tribunal or other appropriate forum, and the User hereby consents to that jurisdiction.
    Note:- Further, in case of inconsistency between the Terms and any specific term and condition pertaining to a specific Product/Facility, the specific term and condition of that particular Product/Facility shall prevail.
  • Supplemental Terms for Recharges and Bill Payments
    TCC facilitates Recharges & Bill Payment services that allow you to view Your bills or eligible prepaid plans and make payments to Billers through the TCC App. You understand that the Bill Payment Services provided through TCC are either provided (i) by a Bharat Bill Payment Operating Unit ("BBPOU") under the Bharat Bill Payment System ("BBPS") infrastructure, where the Biller is registered with NPCI to participate within BBPS; or (ii) by a Biller aggregator with whom TCC has entered into a contractual arrangement. You further understand that TCC only facilitates bill presentment and bill payment and is either (i) an agent of the BBPOU in accordance with Applicable Law, where the Biller is registered with NPCI for BBPS; or (ii) a bill payment facilitator.
    Definitions:
    • "BBPOU" means Bharat Bill Payment Operating Unit operating under the applicable Bharat Bill Payment System regulatory framework – India Ideas Com Limited (“Billdesk”) is currently the BBPOU for TCC (https://www.billdesk.com/web/)
    • "Biller" means a biller, including Prepaid Service Providers for Bill Payment Services either through a biller aggregator or a BBPOU, to whom a User can initiate bill payment on TCC.
    • "Bill Payment Services" means the facility provided to Users on TCC to view bills or pre-paid plans and make payments to Billers and receive other ancillary services.
  • Use of Recharges & Bill Payments

    To use the Recharges & Bill Payments Services, you will need to download the TCC application. .TCC offers a convenient and secure way to make payments towards identified biller(s) using a valid payment account. Depending upon the specific service availed by you (i) the specific features of the service may differ; (ii) the number of billers available over the service may differ; (iii) the type and range of payment methods that can be used to make a payment may differ; (iv) the charges, fees for availing the service or any aspect of the service may differ. TCC reserves the right to charge fees in relation to the use and/or termination of the Recharges & Bill Payments Services including, without limitation, to revise such fees. These charges shall be effective from the time when they are posted on the TCC app on which you are availing the specific service. You are bound by such revisions and should visit the TCC app to review the applicable fees, which may vary from time to time. In the event that you stop or seek a reversal of the payment instructions as may have been submitted, TCC shall be entitled to charge and recover from you and You shall be liable to pay such charges.

    In using the Recharges & Bill Payment service, you agree to:

    provide true, accurate, current and complete information about Yourself (“Registration Data”), Your payment account details (“Payment Data”), Your biller details (“Biller Data”); and

    Maintain and promptly update the Registration Data, Payment Data and Biller Data to keep it true, accurate, current and complete. If You provide any information that is untrue, inaccurate, not current or incomplete, or TCC has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, TCC has the right to suspend or terminate Your account and refuse any and all current or future use of the TCC Services/TCC Platform (or any portion thereof). The term biller includes telecom operators.

    TCC assumes no responsibility and shall incur no liability if it is unable to affect any payment instruction(s) on the payment date owing to any one or more of the following circumstances:

    • If the payment instruction(s) issued by You is/are incomplete, inaccurate, invalid and delayed;
    • If the payment account has insufficient funds/limits to cover for the amount as mentioned in the payment instruction(s);
    • If the funds available in the payment account are under any encumbrance or charge;
    • If Your bank or the clearing centre refuses or delays honouring the payment instruction(s);
    • If payment is not processed by biller upon receipt;
    • Circumstances beyond the control of TCC (including, but not limited to fire, flood, natural disasters, bank strikes, power failure, systems failure like computer or communication lines breakdown, unforeseeable causes, or interference from an outside force).
    • In case the bill payment is not affected for any reason, you will be intimated about the failed payment.
  • Setting up Bill Payment Services

    To use the Bill Payment Services, You may be required to provide us with your bill account information for Billers with whom you would like to make payments (such as your customer account number, registered phone number or customer ID) and any other information necessary for us to access your account and bill/plan details with such Billers ("Bill Payment Account Information"). By using the Bill Payment Services, you expressly authorize TCC to access, use and store Your Bill Payment Account Information and bill details on an ongoing basis, on your behalf for the purpose of providing Bill Payment Services to You.

  • Settlement Timing

    Instant/real time confirmation of bill payment receipt which would help curbing instances of fraud where the agent may accept the payment but not make the payment, defer the payment, make payment to wrong account, fetch wrong details or even in cases where he is unable to generate and provide a receipt.

  • Refund and Recon

    Refunds (if applicable) for transactions will be made to the original payment method within 5-7 working days.
